1. Service provider
The website lks-saun.ee and sauna services offered through it are provided by KROOTUSE INVEST OÜ, registry code 12392258, VAT number EE102003918, registered address Mahtra tn 50a, Lasnamäe linnaosa, 13812 Tallinn, Harju maakond, Estonia (the “service provider”). 2. Application of these terms
These terms apply to use of the website and bookings for the sauna and related extras. The service description, date, time, duration, price and selected extras shown during booking, together with these terms and the booking policy, form the agreement between the parties.
3. Booking and price
The customer must provide accurate, working contact details and check the booking details before payment. Consumer prices include applicable taxes unless clearly stated otherwise. Optional services and additional charges are shown in the booking flow or agreed separately with the customer. A booking is confirmed after the required advance payment has been received successfully and the service provider has confirmed the booking.
4. Advance payment and the Montonio payment solution
A 35% advance payment is required to confirm a booking. Bank and card payments are processed through the Montonio payment solution. The terms of Montonio and the relevant bank or card-service provider also apply to the selected payment method. Legal information about Montonio payment services is available on the Montonio website.
The customer enters payment and authentication information in the secure environment of Montonio, the bank or the card-service provider. The LKS Sauna website does not process or retain the customer's full card number, card security code or online-banking authentication credentials. The website receives the payment status and transaction reference needed to confirm payment. The balance and agreed additional charges are payable as shown during booking or on site.
5. Cancellation and rescheduling
If the customer cancels fewer than 14 days before the agreed service time, the advance payment is non-refundable. In that case, the customer may move the booking to another available date at the original price; the new date is subject to availability. A rescheduling request must be sent to the service provider. Other rules, including prices for extensions and extras, are set out in the booking policy.
6. Right of withdrawal
A sauna service booked for a specific date or period is a leisure service for which the 14-day distance-contract withdrawal right does not apply under § 53 (4) 72 of the Estonian Law of Obligations Act. This does not limit the customer's statutory rights if the service is not provided or does not conform to the agreement.
7. Use of the service and liability
The customer is responsible for their own conduct and that of their guests and must follow reasonable safety, use and house rules provided on site. The provider may suspend the service to protect safety or property where instructions are materially breached. The customer is responsible for direct property damage caused by the customer or their guests to the extent permitted by law. The service provider is liable for breach of its obligations under applicable law.
8. Changes or interruption by the provider
If the service cannot be provided at the agreed time for a reason attributable to the provider, the provider will contact the customer and, where possible, offer another date or refund the amount received for the unprovided service. In a force-majeure situation, the parties will resolve the matter in good faith and under applicable law.
9. Complaints and disputes
Please first send a complaint to the service provider by email. The provider responds to a consumer's written complaint within 15 days. If no agreement is reached, a consumer residing in Estonia may contact the Consumer Disputes Committee at TTJA. Estonian law applies without limiting mandatory consumer protection granted by applicable law.
